Closing your account voluntarily does not exempt you from responsibility for any prior actions or obligations, including outstanding debts, chargebacks, or investigations into suspected violations. In cases where you have self-excluded for responsible gambling reasons, we will implement appropriate blocks to prevent account reopening during the self-exclusion period, and we may adopt additional measures to prevent you from creating new accounts. If your account remains inactive for a prolonged period, we may classify it as dormant and apply procedures outlined in our policies, which may include periodic notifications, account closure, and the handling of unclaimed funds as required by law.
Upon account termination, whether initiated by you or by Winum, the Agreement formed by these Terms shall no longer apply to you, except for those provisions that are intended to survive termination, such as limitation of liability, intellectual property rights, dispute resolution, and any obligations regarding outstanding balances or compliance requirements. We may retain your personal and transactional data for a period required to meet our legal, regulatory, and anti-fraud obligations, even after your account is closed. You understand that if you later decide to return to the platform after voluntary closure (and no self-exclusion or permanent ban applies), you may be required to undergo a new registration and verification process.
Limitation of Liability
To the maximum extent permitted by applicable law, Winum, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the services, even if advised of the possibility of such damages. This includes, without limitation, damages for loss of profits, loss of data, interruption of business, or any other commercial or personal loss resulting from errors, malfunctions, outages, delays, or unauthorized access to or alteration of your transmissions or data. Final Provisions
These Terms constitute the entire agreement between you and Winum regarding your use of the services and supersede all prior or contemporaneous understandings, representations, or agreements, whether written or oral, relating to the same subject matter. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect. Our failure or delay in exercising any right, power, or remedy under these Terms shall not operate as a waiver of such right, power, or remedy, nor shall any single or partial exercise of any right preclude any other or further exercise of the same or any other right.
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this provision shall be null and void. Winum may assign or transfer its rights and obligations under these Terms, in whole or in part, to any affiliated entity or successor in connection with a merger, acquisition, corporate reorganization, or other business transaction, provided that such assignment does not materially reduce the level of protection afforded to you under these Terms.
